ImgPhotoEditor Terms of Service

These Terms govern your use of imgphotoeditor.ai and the ImgPhotoEditor AI photo editing service (the Service). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old and able to enter a binding agreement. Account access is provided through Google sign-in. You are responsible for activity under your Google account and for keeping it secure. Do not share access, automate account creation, or evade free-credit limits.

2. The Service

ImgPhotoEditor accepts images and text instructions and uses third-party AI models to create edited images. AI outputs can be inaccurate, unexpected, or similar to material produced for others. We do not promise that an output is unique, error-free, suitable for a specific purpose, or free from third-party claims. Review every output before relying on or publishing it.

Models, credit costs, limits, processing times, and features may change. We may temporarily limit or suspend a model for safety, capacity, provider, or legal reasons.

3. Your content and permissions

You retain any rights you have in images, prompts, and outputs. You grant us a limited, worldwide license to host, copy, transmit, process, and display that content only as needed to operate, secure, support, and improve the Service. You represent that you have all rights and permissions needed to upload and edit the content.

We do not claim ownership of your output. Your ability to use an output may be limited by applicable law, third-party rights, or the terms of an underlying model provider.

4. Acceptable use

You must follow our Acceptable Use Policy. Prohibited activity includes unlawful content, sexual content involving minors, non-consensual intimate imagery, deceptive impersonation, malicious automation, infringement, attempts to bypass security or credit controls, and use that harms another person. We may block content or suspend accounts when reasonably necessary to protect users, providers, or the Service.

5. Credits

Daily Free Credits refresh at UTC 00:00 and do not roll over. Subscription VIP Credits refresh on their monthly cycle and do not roll over. VIP Credits from one-time Credit Packs do not expire while the Service and account remain available. Credits have no cash value, cannot be transferred, and are not a stored-value account.

Credits are charged when a generation task is accepted. If an accepted task fails before a usable output is stored, the Service automatically attempts an idempotent credit refund. Dissatisfaction with a technically successful output does not by itself qualify for a credit refund.

6. Subscriptions, payments, and taxes

Stripe processes payments. Subscription plans renew automatically for the selected monthly or annual billing period until canceled. Cancellation stops renewal and takes effect at the end of the paid period. Annual subscriptions are billed annually, while subscription credits are delivered in monthly cycles. Prices are in USD. Taxes may be added when tax collection is enabled or legally required.

Payment refunds are governed by our Refund Policy. Stripe's checkout and customer portal may be subject to Stripe's own terms.

7. Storage and deletion

Creation limits and retention depend on account status. Expired or manually deleted media may be permanently removed and cannot be restored. Guest results are temporary and are not transferred into My Creations after sign-in.

An account deletion request disables access immediately, queues media for deletion, cancels subscription renewal, and schedules profile anonymization after a 30-day operational and fraud-prevention period. Some payment, security, and audit records may be retained when required for legal, tax, chargeback, or security purposes.

8. Intellectual-property reports

If you believe content processed through the Service infringes your rights, email [email protected] with your contact details, identification of the work and content, the relevant URL or task information, and a good-faith explanation. We may request identity or authority verification.

9. Suspension and termination

We may restrict or terminate access for material or repeated violations, fraud, abuse, legal demands, risk to the Service, or nonpayment. You may stop using the Service at any time and may request account deletion from Account Settings.

10. Disclaimers and liability

To the maximum extent allowed by law, the Service is provided as is and as available, without warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or output quality. We are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, goodwill, or business opportunity. Our total liability relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, except where applicable law does not permit that limit.

11. Changes

We may update these Terms. Material changes will be communicated through the Service or by email when reasonably practical. Continued use after the effective date of an update means you accept the revised Terms.
